В статье рассмотрено развитие института судимости, вопросы ее погашения и снятия в советском уголовном законодательстве. Обосновано, что правовое регулирование судимости вышло на высокий уровень, поэтому современному законодателю целесообразно использовать положительный опыт, накопленный в советский период. Предложено сопоставить нормы ст. 57 УК РСФСР 1960 г. и ст. 86 УК РФ о погашении судимости и вернуть отдельные предписания, установленные советским законодателем в действующий уголовный закон. Можно ожидать, что это повысит эффективность и качество противодействия рецидивной преступности.

The article examines the development of the institution of criminal record, issues of its expungement and removal in the Soviet criminal legislation. It is substantiated that the legal regulation of criminal record has reached a high level, therefore it is advisable for the modern legislator to use the positive experience accumulated in the Soviet period. It is proposed to compare the provisions of Art. 57 of the Criminal Code of the RSFSR of 1960 and Art. 86 of the Criminal Code of the Russian Federation on expungement of criminal record and to return certain instructions established by the Soviet legislator to the current criminal law. It can be expected that this will increase the efficiency and quality of counteraction to recidivism.
