Цель работы: проведение комплексного сравнительно-правового анализа механизмов обеспечения АТЗ объектов и территорий в Российской Федерации и зарубежных государствах, а также выявление тенденций развития уголовно-правового регулирования в данной сфере на примере новейшего законодательства Великобритании. Результат: в статье раскрыта эволюция подходов к противодействию терроризму от преимущественно реактивной модели к превентивной, основанной на предупреждении угроз. Проанализированы особенности международного и национального правового регулирования. Установлено, что российская модель характеризуется наличием специальных уголовно-правовых норм, предусматривающих ответственность за нарушение требований АТЗ, однако такая ответственность связана с наступлением общественно опасных последствий. Особое внимание уделено уникальному опыту Великобритании, где с принятием Terrorism (Protection of Premises) Act 2025 сформирована новая модель правового регулирования, основанная на возложении обязанностей по обеспечению безопасности на владельцев объектов. Практическая ценность: результаты исследования могут быть использованы при совершенствовании российского уголовного законодательства, в частности при разработке норм, направленных на усиление превентивного потенциала требований АТЗ, а также криминализацию неисполнения обязательных предписаний уполномоченных органов. Выводы работы представляют интерес для правотворческой деятельности, правоприменительной практики, а также для научных исследований в области уголовного права и обеспечения общественной безопасности.

Purpose of the work: to conduct a comprehensive comparative legal analysis of mechanisms ensuring anti-terrorist protection (ATP) of facilities and territories in the Russian Federation and in foreign states, as well as to identify trends in the development of criminal law regulation in this field, using the latest legislation of the United Kingdom as a case study. Study findings: the article examines the evolution of approaches to counter-terrorism, shifting from a predominantly reactive model to a preventive one based on threat anticipation and mitigation. The features of international and national legal regulation are analyzed. It is established that the Russian model is characterized by the presence of specific criminal law provisions providing liability for violations of ATP requirements; however, such liability is generally linked to the occurrence of socially dangerous consequences. Particular attention is paid to the experience of the United Kingdom, where the adoption of the Terrorism (Protection of Premises) Act 2025 has established a new regulatory model based on the imposition of security obligations on premises owners and operators. Practical importance: the findings of the study may be used to improve Russian criminal legislation, particularly in developing provisions aimed at strengthening the preventive potential of ATP requirements, as well as in criminalizing non-compliance with mandatory orders issued by authorized bodies. The conclusions are relevant for legislative development, law enforcement practice, and academic research in the field of criminal law and public safety.
