<p>This article provides a comprehensive study of the legal status of fan-created works within the framework of Russian copyright law. The relevance of the topic is driven by the rapid development of this large-scale sociocultural phenomenon in the digital age, which, on the one hand, has become a form of collective creativity and self-expression for millions of fans, and on the other hand, has entered into systemic conflict with traditional paradigms of intellectual property. The author notes that current legislation lacks a special regime for regulating this area, creating a legal vacuum and risks for content creators. As part of the study, the author formulates and substantiates a definition of the concept of «fan-created work,» identifying its key criteria: objective form, creative nature, specific subject (a fan), non-commercial purpose of creation, and the presence of protected elements of the original work. The central focus of the work is the analysis of the possibility of applying the regime of free use to fan creativity. The author sequentially tests the hypothesis for compliance with the «three-step test» established in clause 5 of Article 1229 of the Civil Code of the Russian Federation, arguing that non-commercial fan creativity does not conflict with the normal exploitation of the original work and often contributes to maintaining and even increasing its commercial value. Based on the analysis, specific proposals for improving the civil legislation of the Russian Federation are developed and presented, namely: introducing a definition into Article 1260 of the Civil Code and adding a new clause to Article 1274 of the Civil Code, legalizing the creation and use of fan-created works without the copyright holder’s consent and without remuneration. These measures aim to eliminate legal uncertainty and establish a fair balance of interests between copyright holders and the fan community.</p>
<kwd-group xml:lang="ru"><kwd>фанатское творчество</kwd><kwd>авторское право</kwd><kwd>производное произведение</kwd><kwd>свободное использование</kwd><kwd>трехступенчатый тест</kwd><kwd>Гражданский кодекс РФ</kwd><kwd>правовое регулирование</kwd><kwd>цифровая культура</kwd><kwd>некоммерческое использование</kwd><kwd>баланс интересов</kwd></kwd-group><kwd-group xml:lang="en"><kwd>fan creativity</kwd><kwd>copyright</kwd><kwd>derivative work</kwd><kwd>free use</kwd><kwd>three-step test</kwd><kwd>Civil Code of the Russian Federation</kwd><kwd>legal regulation</kwd><kwd>digital culture</kwd><kwd>non-commercial use</kwd><kwd>balance of interests</kwd></kwd-group></article-meta></front><back><ref-list><ref id="ref1"><mixed-citation publication-type="other" xml:lang="ru">Дозорцев В.А.
