Статья посвящена проблемным аспектам предварительного расследования дорожно-транспортных происшествий (ДТП), совершённых в условиях обоюдной вины или при наличии нескольких субъектов, чьи противоправные действия находятся в причинно-следственной связи с наступившими последствиями. Автор анализирует специфику установления механизма ДТП в ситуациях «цепных» столкновений и пересечения нарушений ПДД разными участниками движения. Особое внимание уделено трудностям оценки доказательств при противоречивых показаниях фигурантов, а также роли комплексных судебных автотехнических и судебно-медицинских экспертиз в разграничении степени ответственности каждого лица. В работе рассматриваются типичные следственные ошибки при квалификации действий водителей и предлагаются рекомендации по совершенствованию тактики осмотра места происшествия и проведения следственных экспериментов в условиях множественности виновных

The article is devoted to problematic aspects of the preliminary investigation of road traffic accidents committed in situations of mutual fault or involving several persons whose unlawful actions are causally connected with the resulting consequences. The author analyses the specific features of establishing the mechanism of a road traffic accident in cases of chain collisions and overlapping violations of traffic regulations by different road users. Special attention is paid to the difficulties of assessing evidence in the presence of contradictory statements by the persons involved, aswell as to the role of comprehensive forensic automotive technical and forensic medical examinations in determining the degree of responsibility of each person. The article examines typical investigative errors in the legal classification of drivers’ actions and proposes recommendations for improving the tactics of inspecting the accident scene and conducting investigative experiments in cases involving multiple at-fault parties
