Работа посвящена анализу понятия «общественное здоровье», индивидуальных прав и свобод, связанных с данной тематикой, через призму норм Конституции РФ, федерального законодательства России, международных документов, актов субъектов РФ, а также их столкновения с публичным интересом. Актуальность темы выражается в постоянном пересечении общественного интереса, прав личности и социальных норм между собой, что может вызвать конфликт в тех случаях, когда государство стоит перед выбором: защитить права одного человека и большой группы людей. Также важно отметить, что миропорядок находится в постоянном динамизме, возникают новые проблемы, требующие решений, иногда радикальных. Рассматриваемый вопрос является актуальным и приобретает свою научную разработанность в связи с новыми трудностями, с которыми сталкиваются государства. В статье акцент сделан на рассмотрение действующего законодательства, анализ ситуаций, складывающихся в стране, четко отражающих конфликт публичных и индивидуальных интересов. Целями научной работы являются анализ действующего на территории РФ законодательства, регулирующего права и свободы человека и гражданина, отдельных примеров ограничений индивидуальных интересов в пользу публичных. Результатами являются выполнение поставленных целей: рассмотрено и проанализировано действующее законодательство, отражающее права и свободы человека, случаи их ограничения; сделаны выводы о конфликте, возникающим между индивидуальным и публичным интересом.

The work is devoted to the analysis of the concept of “public health”, individual rights and freedoms related to this topic through the prism of the norms of the Constitution of the Russian Federation, federal legislation of Russia, international documents, acts of the subjects of the Russian Federation, as well as their collision with the public interest. The relevance of the topic is expressed in the constant intersection of public interest, individual rights and social norms with each other, which can cause conflict in cases where the state is faced with a choice: to protect the rights of one person and a large group of people. It is also important to note that the world order is in constant dynamism, new problems arise that require solutions, sometimes radical ones. The issue under consideration is relevant and is gaining its scientific relevance in connection with the new difficulties faced by States. The article focuses on the consideration of current legislation, the analysis of situations in the country that clearly reflect the conflict of public and individual interests. The objectives of the scientific work are to analyze the legislation in force on the territory of the Russian Federation regulating the rights and freedoms of man and citizen, individual examples of restrictions on individual interests in favor of public ones. The results are the fulfillment of the set goals: the current legislation reflecting human rights and freedoms, cases of their restrictions are considered and analyzed; conclusions are drawn about the conflict arising between individual and public interest.
