Одной из основных задач социального государства является надлежащая забота о здоровье всех его граждан, его охрана. Вопросы укрепления общественного здоровья были предметом исследования в работах как зарубежных, так и отечественных ученых, таких как Н.И. Вишняков, А.А. Шабунова, М.Г. Свередюк, О.В. Ушакова. В данной статье рассматриваются конституционно-правовые аспекты укрепления общественного здоровья в России в свете поправок в Конституцию России 2020 г., предлагаются возможные пути совершенствования механизмов и средств для достижения более высоких показателей общественного здоровья в России. Целью исследования является анализ конституционно-правовых основ укрепления общественного здоровья в России, правовых механизмов и инструментов, используемых государством для обеспечения и поддержания здорового образа жизни населения, эффективность их реализации. Методологическая основа: историко-правовой, формально-юридический, системно-структурный методы исследования, методы наблюдения, правового мониторинга. Результаты: исследованы исторические аспекты становления и развития понимания термина «общественное здоровье», проанализированы основы института здравоохранения в советских конституциях, конституционные положения об охране здоровья, праве каждого на охрану здоровья и медицинскую помощь в Основном Законе страны 1993 г., поправки в Конституцию России 1993 г., а также практические аспекты реализации норм, касающихся укрепления общественного здоровья. Выводы: российское государство продолжает занимать центральное положение в определении дальнейшей политики здравоохранения, подчеркивая важность заботы о своем здоровье со стороны каждого гражданина. На государственном уровне должны быть созданы все необходимые для этого условия путем обеспечения качественного уровня здравоохранения. Нормы современной Конституции РФ создают прочный базис для формирования специального законодательства в сфере здравоохранения, реализации конституционных норм в сфере обеспечения охраны здоровья российских граждан, укрепления общественного здоровья нации в целом.

One of the main tasks of the welfare state is the proper care of the health of all its citizens, its protection. The issues of strengthening public health have been the subject of research in the works of both foreign and domestic scientists, such as N.I. Vishnyakov, A.A. Shabunova, M.G. Sveredyuk, O.V. Ushakova. This article examines the constitutional and legal aspects of strengthening public health in Russia in the light of amendments to the Constitution of Russia in 2020, and suggests possible ways to improve mechanisms and means to achieve higher indicators of public health in Russia. The purpose of the study is to analyze the constitutional and legal foundations for strengthening public health in Russia, the legal mechanisms and tools used by the state to ensure and maintain a healthy lifestyle of the population, and the effectiveness of their implementation. Methodological basis: historical-legal, formal-legal, systemic-structural research methods, methods of observation, legal monitoring. Results: the historical aspects of the formation and development of the understanding of the term “public health” are investigated, the foundations of the Institute of health care in Soviet constitutions, constitutional provisions on health protection, everyone’s right to health protection and medical care in the Basic Law of the country of 1993, amendments to the Constitution of Russia of 1993, as well as practical aspects of the implementation of norms related to strengthening public health. Conclusions: the Russian state continues to occupy a central position in determining further health policy, emphasizing the importance of taking care of one’s health on the part of every citizen. All necessary conditions for this should be created at the state level by ensuring a high-quality level of healthcare. The norms of the modern Constitution of the Russian Federation create a solid basis for the formation of special legislation in the field of healthcare, the implementation of constitutional norms in the field of ensuring the health of Russian citizens, and strengthening the public health of the nation as a whole.
